1. Acceptance of Terms
By accessing and using the Synermatica application ("the App"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using this App's particular services, you shall be subject to any posted guidelines or rules applicable to such services.
2. Disclaimer of Warranties
The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The developer explicitly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The developer makes no warranty that (i) the App will meet your requirements, (ii) the App will be uninterrupted, timely, secure, or error-free, or (iii) the results that may be obtained from the use of the App will be accurate or reliable.
3. Limitation of Liability
You expressly understand and agree that the developer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the developer has been advised of the possibility of such damages).
This includes resulting from: (i) the use or the inability to use the App; (ii) unauthorized access to or alteration of your transmissions or data; or (iii) any other matter relating to the App.
4. Indemnification
You agree to indemnify and hold the developer, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the App, your violation of these Terms of Service, or your violation of any rights of another.
5. Modifications
The developer reserves the right to modify or discontinue, temporarily or permanently, the App (or any part thereof) with or without notice. You agree that the developer shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the App.
